1. General provisions

These terms govern the use of heroesorchestra.com (the "Site"), operated by the Heroes Orchestra Foundation (Fundacja Heroes Orchestra), Synów Pułku 7/30, 01-354 Warsaw, Poland, KRS 0000730120, NIP 5223124977 (the "Foundation"). Using the Site constitutes acceptance of these terms.

2. Nature of the Site

The Site presents the activity of Heroes Orchestra, concert dates, recordings and photography, offers a newsletter signup and lets you order the CDs and vinyl records released by the Foundation (see section 3). Tickets, digital music and apparel are sold by external platforms the Site links to.

3. Orders for CDs and vinyl

The seller of CDs and vinyl ordered through the Site is the Foundation (details in section 1). You place an order using the form on the Order page. Once it is submitted we show a confirmation with an order number and payment details, and send a copy to the e-mail address you provided. The sales contract is concluded when you receive that confirmation.

Prices in the form include VAT: they are in Polish złoty for shipping within Poland and in euro for shipping abroad. The shipping cost depends on the delivery method (Poland) or the shipping zone (abroad) and is shown in the summary before you submit the order. CDs and vinyl ship as separate parcels, so an order containing both formats carries a shipping charge for each. We do not ship to Russia, the United States or Israel.

Payment is made up front by bank transfer to the Foundation's account or via PayPal, as described in the confirmation; please quote the order number in the transfer title. We ship once the payment is booked — usually within 48 hours in Poland and once a week abroad. Orders left unpaid for 14 days are cancelled.

As a consumer you may withdraw from the contract without giving a reason within 14 days of receiving the parcel. Send a statement to ho_records@heroesorchestra.com (quoting the order number) and return the undamaged goods to the Foundation's address at your own cost. We refund the amount paid within 14 days of receiving your statement, but not before the goods are back with us.

The Foundation is liable for the conformity of the goods with the contract under consumer protection law. Complaints (for example a damaged parcel, a missing record or one that does not match the order) should be sent to ho_records@heroesorchestra.com together with the order number; we handle them within 14 days.

4. Newsletter

The newsletter is voluntary and free. Delivery is handled by Mailchimp; signup may require confirmation (double opt-in). You can unsubscribe at any time using the link included in every message. Data processing is described in the privacy policy.

5. Intellectual property

Site content (texts, photographs, audio and video recordings and the Heroes Orchestra logo) is protected by copyright and belongs to the Foundation or is used with its authors' consent. Copying or distributing it without permission is prohibited.

Heroes of Might and Magic and related trademarks belong to Ubisoft Entertainment. Heroes Orchestra is an independent artistic initiative, not affiliated with or endorsed by Ubisoft.

6. External links

The Site links to external platforms (ticket vendors, Payhip, tshirt-gallery.pl, YouTube, Facebook, Instagram, SoundCloud, among others). The Foundation is not responsible for their content, terms or privacy practices. Purchases made there are subject to the respective seller's terms.

7. Liability

The Foundation strives to keep the Site's information (including concert dates) accurate, but does not guarantee uninterrupted availability or freedom from errors. Binding event information is provided by organizers and ticket vendors.

8. Contact and complaints

Comments about the Site can be sent to the addresses listed in the Contact section; order matters are handled at ho_records@heroesorchestra.com. We respond promptly, usually within 14 days.

9. Final provisions

Matters not covered here are governed by Polish law, in particular the Civil Code and the Consumer Rights Act; mandatory consumer protections of your country of residence remain unaffected. The Foundation may amend these terms; the new version applies upon publication on the Site, and orders placed earlier are governed by the version in force on the day they were placed.
